& LEGAL NOTICE

1. LEGAL INFORMATION

  •  Jurisdiction: These terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Broward County, FL.

2. SERVICE & CUSTOMIZATION

 

Artive Design provides a bespoke digital artwork service. By placing an order, you agree to provide accurate information through our storytelling questionnaire.

​

  •   Production Time: 10 business days from the receipt of the completed questionnaire.

  •   The Deliverable: You will receive one (1) high-resolution digital master file. No physical product is shipped.

​

3. REVISIONS & VALIDATION

​

  •   Included: One (1) round of minor revisions is included in the initial price.

  •   Additional Edits: Any further modifications or complete redesigns will be subject to additional fees.

  •   Silent Approval Rule: Upon receiving your preview, you have 14 days to request your included revision. If no response is received within this period, the design will be considered final and approved, and the master file will be sent as-is.

4. NO REFUND POLICY 

​

Due to the highly personalized and digital nature of our artworks, all sales are final. Once the design process has begun, no refunds, cancellations, or returns will be accepted, in accordance with Florida law regarding custom-made goods.

5. INTELLECTUAL PROPERTY & USAGE 

​

  • Ownership & Copyright: Artive Design retains all intellectual property rights and full copyright of the artwork created. Purchase of a design does not transfer ownership of the copyright to the client.

  • Personal Use Only: The artwork is for your private, non-commercial use only. Resale, sub-licensing, or commercial redistribution of the file is strictly prohibited.

  • Commercial Use & Partnerships: The standard purchase is for personal use only. If you are a brand interested in a collaboration, or if you wish to use the artwork for commercial purposes (resale, branding, or merchandise), you must contact me directly to discuss a commercial license and specific terms.

  • Printing: Artive Design is NOT responsible for the quality of the final print. Any issues arising from third-party services (e.g., VistaPrint, Ninja Transfer) are the sole responsibility of the client.

6. PROMOTIONAL RIGHTS 

​

By validating your order, you grant Artive Design the right to display the created artwork on our website and social media platforms for promotional purposes.

  •   Privacy: If you wish for your design to remain private, you must explicitly notify us in writing at the time of purchase.

  •   Watermark: Artive Design reserves the right to display works-in-progress or final designs with a digital watermark or within a mockup setting.

7. AVAILABILITY 

To maintain our quality standards, we limit orders to 10 custom pieces per month. Once this limit is reached, the service will appear as "Sold Out" until the next booking cycle.
